Terms of Service

Fan accounts are optional. You can submit requests and tips as a guest without creating an account. Creating a fan account enables additional features such as following artists, receiving notifications, and viewing request history.

Musician and DJ accounts require registration via email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Tips are voluntary payments from fans to artists. By submitting a tip, you acknowledge that it is a gratuity and not a payment for goods or services.

All payment processing is handled by Stripe. By making a payment, you also agree to Stripe's Terms of Service. Encore does not store credit card numbers or sensitive payment information.

Tips are generally non-refundable. See our Refund Policy for exceptions.

The Platform may charge a service fee on each transaction. Artists who connect their own Stripe account receive tips directly, minus the platform fee and Stripe processing fees.

Song titles, artist names, and related metadata displayed on the Platform are for reference purposes only. Encore does not claim ownership of any musical works. Artists are responsible for ensuring they have the right to perform requested songs at their events.

Encore does not host, stream, distribute, or reproduce any copyrighted musical compositions or sound recordings. The Platform displays song titles and artist names solely as textual references to facilitate live performance requests. All intellectual property rights in the underlying musical works remain with their respective owners.

Artists who list songs on the Platform represent that they have the appropriate performance rights (e.g., venue blanket licenses through ASCAP, BMI, SESAC, or similar performing rights organizations) for the songs they perform. Encore assumes no responsibility for verifying or ensuring compliance with music licensing requirements.

Encore is a platform that facilitates song requests and tips between fans and artists. Submitting a song request and/or tip does not create a binding obligation for the artist to perform the requested song.

Artists retain full discretion over which requests they accept, reject, or prioritize during a performance. Factors including time constraints, setlist planning, audience dynamics, technical limitations, and artistic judgment may affect whether a request is fulfilled.

Encore assumes no liability for any request that is not performed, regardless of whether a tip was included. Tips are voluntary gratuities as described in Section 5 and are not conditional on request fulfillment. See our Refund Policy for information about refund eligibility.

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Matt Senjem Music LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or profits.

Without limiting the foregoing, Encore is not responsible for: (a) the conduct, actions, or omissions of any artist or fan using the Platform; (b) the quality, timing, or completion of any musical performance; (c) disputes between fans and artists regarding requests or tips; or (d) any third-party content, including song titles, artist names, or user-submitted dedications displayed on the Platform.
